The petitioner seeks bail in Bhabua P.S. Case No. 260 of 2021, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act. As per the FIR, this petitioner shot dead the son of informant.

It is submitted on behalf of the petitioner that though petitioner is alleged to have caused firearm injury to the son of informant, as a result of which he died, but no motive has been assigned to him and he is resident of other village. During course of investigation, the police has not found blood on the place of occurrence. Petitioner is in custody since 16.07.2021 having no criminal antecedent.

No.67493 of 2021(2) dt.28-02-2022 2/2 Counsel for informant however, vehemently opposed the prayer for bail and submitted that petitioner is sole assailant of the deceased and there is specific and direct allegation of causing firearm injury to the son of informant resulting into his death.

Considering the facts aforesaid and the nature of accusation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
