JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 13.5.2014 in a case registered for the offences punishable under Sections 379,420 and 411/34 of the Indian Penal Code.

It is alleged that the informant gave his auto rickshaw to ply to his brother in law Tunnu Prasad which was subsequently stolen away. The auto rickshaw was recovered from one Subodh Kumar. Subodh Kumar named certain accused persons who have been granted bail vide Cr. Misc. No.35672 of 2014. It is submitted by the learned counsel for the petitioner that there is no recovery from the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
