The petitioner seeks bail in a case of patricide punishable under Section 302 of the Indian Penal Code. Taking into consideration the fact that the petitioner is alleged to have committed crime of patricide killing his own father by assaulting him on his head by use of Lorha (a heavy solid stone), this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of bail. Accordingly, his prayer for bail in connection with Sessions Trial No. 558 of 2014 (Jokihat P.S. Case No. 192 of 2013), pending in the court of learned Adhoc Addl. Sessions Judge, 4th Araria, is rejected. However, it appears that the case of the petitioner has been committed to the court of sessions in the year 2014 and the petitioner is in judicial custody since 22.07.2013.

Therefore, the learned trial court is directed to frame charge against the petitioner, if not already framed, and all endeavours shall be made to conclude his trial at an early date preferably within a period of one year from the date of framing of charge.
