This is an application for bail in connection with Sessions Trial No. 44 of 2017, arising out of Deokhund P.S.Case No. 02 of 2017 registered for the offences punishable under Sections 302/120B of the Indian Penal Code.

Allegation against the petitioner is of giving spade blow on the deceased.

It has been submitted on behalf of the petitioner that there is no repetition of giving spade blow on the deceased and he has no intention to kill him and he is in custody for seven months. Heard learned APP also, who has opposed the prayer for bail stating that the allegation is supported by the post mortem report.

Patna High Court Cr.Misc. No.33467 of 2017 (3) dt.22-08-2017 2/2 Having heard both sides and considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.

However, as the case has already been committed to the court of sessions, learned trial court is directed to expedite the trial and try to conclude it within nine months. With the above observation, this application is dismissed.
