JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Jakkanpur P.S. Case no. 208 of 2017, registered under Sections 147, 148, 149, 341, 323, 380, 384 and 448 of the Indian Penal Code.

The accusation is that on 06.07.2017 at about 9.30 P.M. while informant was going to sleep after closing the door in the meantime, three persons entered in his house. Out of them, one person was armed with pistol and one person was armed with knife. Thereafter, informant came in fear and one person demanded key of the Godrej then informant indicated about the place where key of the almirah was kept. Thereafter, one person opened the Almirah and took cash of Rs. 10,000/-,

Patna High Court Cr.Misc. No.50291 of 2018(2) dt.20-09-2018 2/2 and Golden Jhumka of his wife. Further allegation of informant is that before two months petitioner had raised the dispute with his wife Lalita Devi, who is Anganbari Sevika, for distribution of Koshagar.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Further submission is that, in fact, petitioner is co-villager of the informant and he raised objection regarding irregularity in the Koshagar by the wife of the informant, due to that reason, petitioner has falsely been implicated in this case.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-cum-Sub Judge-I, Patna in connection with Jakkanpur P.S. Case No. 208 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
