JUSTICE SUDHIR SINGH ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 364/34 of the Indian Penal Code.

Allegation is that son of the informant and one Bipin Mahto had gone to Bakhri. Thereafter, they had again gone to fishing but informant's son did not return home. Prior to the date of occurrence, due to some quarrel, petitioner and his brother had threatened to kill informant's son.

It has been submitted on behalf of the petitioner that he is in custody since 11.3.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner has been made accused merely on suspicion. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest implication of the petitioner in the present case.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.29584 of 2016 (3) dt.05-09-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-V, Begusarai, in connection with Bakhari P.S. Case no. 52 of 2016 giving rise to Sessions Case no. 343 of 2016. (Sudhir Singh, J) sudip/- U T
