JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 366A of the I.P.C.
Earlier the bail application of the petitioner was rejected by order dated 21.01.2015 vide Cr.Misc.No.42902 of 2014. The said rejection was made with the observation 'at this stage'. In pursuance to the earlier observation, the present bail application has been filed on behalf of the petitioner. A report was called for from the trial court regarding the stage of the case. The same is kept on the record. It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.6.2013. The charge was framed on 10.2.2014 and till date only six witnesses have been examined.
Patna High Court Cr.Misc. No.28317 of 2016 (5) dt.05-10-2016 2/2 There is no chance of the trial being concluded in the near future. The victim girl has already been recovered.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Adhoc A.D.J., Sitamarhi in connection with Sessions Trial No.6 of 2014 arising out of Sitamarhi P.S. case No.904 of 2012.
