Petitioner apprehends his arrest in Manpur P.S. Case No.13 of 2019, registered under Sections 332, 333, 353, 323, 504, 307 and 427 of the Indian Penal Code, under Sections 30(a) and 45 of the Bihar Prohibition and Excise Act as well as under Section 3 of the Prevention of Damage to Public Property Act, 1984.

The informant alleged that on information, the house of Prayag Uraw and Sukhari Ram were searched and country made liquor was recovered. Sukhari Ram and Prayag Uraw managed to flee away. The informant further alleged that many persons assembled there and they started pelting stones but some how the police came out from the place of occurrence. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.51537 of 2019(2) dt.19-08-2019 2/2 petitioner is also named in the FIR but nobody was injured in alleged pelting of stones. In fact the villagers made peaceful protest against the highhandedness of the police but the police implicated the petitioner.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, District West Champaran in connection with Manpur P.S. Case No.13 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
