2. The petitioner apprehends arrest in connection with Piprahi P.S. Case No. 43 of 2023 dated 07.03.2023 instituted for the offence punishable under Sections 341, 323, 324, 307, 354, 504, 379, 506, 447/34 of the Indian Penal Code.

3. The allegation against the petitioner is that he along with co-accused persons came at the house of the informant assaulted and misbehaving with the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and due to petty dispute between the parties an altercation took place. The allegation against the petitioner for disrobing the informant is ornamental. Further he submits that similarly situated co-accused persons namely Most.

Patna High Court CR. MISC. No.57342 of 2023(2) dt.13-09-2023 2/2 Kani Devi and Suresh Paswan have been granted anticipatory bail vide order dated 21.08.2023 in Cr. Misc. No. 53993 of 2023. Petitioner has no criminal antecedent.

5. Learned APP opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner above named be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate- 1st Class, Sheohar / concerned Court, Sheohar in connection with Piprahi P.S. Case No. 43 of 2023, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
