JUSTICE SUDHIR SINGH ORAL ORDER 30-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 384, 385, 327 and 307/34 of the I.P.C.
The prosecution story, in brief, is that the accused persons including the petitioner used to make rangdari demand from the informant as well as from his uncle and on refusal they assaulted them causing bleeding injury.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.7.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The alleged occurrence is said to have taken place because of dispute in
Patna High Court Cr.Misc. No.28419 of 2016 (4) dt.30-08-2016 2/2 respect to management of the temple.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances and the period of custody, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of 5th Additional Sessions Judge, Bhagalpur in connection with Sultanganj P.S. case No.158 of 2015 corresponding to Sessions Case No.709 of 2015.
