This application is for grant of regular bail in connection with Gaya Rail P.S.Case No.52 of 2017, registered for the offences punishable under Sections 08/20(b)(ii)(B) of N.D.P.S. Act and Section 413 of IPC and Section 147 of the Railway Act. Allegation against the petitioner is recovery of 06 kg. Ganja from his bag.
Submission of the learned counsel for the petitioner is that the said bag does not belong to the petitioner and he has been falsely implicated in this case as he was traveling without ticket. The petitioner is in custody for about five months. Heard learned A.P.P. also.
Having heard both sides and in view of the fact that
Patna High Court Cr.Misc. No.33441 of 2017 (2) dt.26-07-2017 2/2 recovery of Ganja is more than small quantity, as such, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it preferably within a year.
With the aforesaid observation, this application is dismissed.
