The petitioner is languishing in custody since 27.03.2014 in a case registered for the offences punishable under Sections 342, 429, 436/34 of the Indian Penal Code. It is alleged that the accused persons tied the hands and legs of the father of the informant and set the dwelling house on fire. They also tried to throw the wife and the children of the informant in the fire but they managed to escape. Learned counsel for the petitioner submits that the accusation has been levelled in the background of the dispute between the parties from before. The allegations are general and omnibus. Statement made in paragraph 3 of the petition that petitioner has no criminal antecedent. The accused Jhabhu Mahto has been granted bail by a Bench of this Court vide order dated
Patna High Court Cr.Misc. No.36326 of 2014 (3) dt.13-01-2015 30.09.2013 passed in Cr. Misc. No. 35597 of 2013. Considering the above facts, the petitioner is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Ad hoc Additional Sessions Judge-VIII, Purnea in connection with S. T. No. 1051 of 2013 arising out of Sarsi P.S. Case No. 104 of 2011.
