The petitioner seeks bail in connection with Bhagwanpur P.S. Case No. 181 of 2014 registered for the offences punishable under Sections 364, 302, 201 and 120B of the Indian Penal Code.
The informant suspected that his two sons namely, Muskan Raj and Abhishek Kumar were kidnapped, while they were playing, by the petitioner and other accused persons. It is submitted that there is no eye witness to the occurrence. The case was lodged after recovery of the dead body. Similarly situated accused persons namely, Naveen Mandal, Bhawni Mandal and Sanjeev Mahton @ Sanjeet Mahton have been granted bail by order dated 19.05. 2015 and 06.07.2015
Patna High Court Cr.Misc. No.11522 of 2015 (3) dt.29-07-2015 passed in Cr. Misc. No. 11736 of 2015 and Cr. Misc. No. 8942 of 2015 respectively. The case of the petitioner stands on similar footing.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Begusarai in connection with Bhagwanpur P.S. Case No. 181 of 2014.
