JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2017 Petitioner has earlier moved this Court and her prayer for bail has been rejected by order dated 17.1.2017 passed in Cr.Misc.No.54940 of 2016 with an observation to expedite the trial.
However, the present application has been filed on behalf of the petitioner stating that another co-accused having similar allegation has been granted bail by this Court by order dated 24.1.2017 passed in Cr.Misc.No. 52607 of 2016 and petitioner is in custody since 4.9.2016 and charge has been framed in this case on 10.7.2017 but till date not a single witness has been examined in this case.
Having heard both sides and in the above facts and circumstances, as charge has been framed in this case, learned trial court is directed to expedite the trial and try to conclude it within
Patna High Court Cr.Misc. No.38004 of 2017 (2) dt.09-08-2017 2/2 three months. If trial is not concluded within the said period, petitioner may renew her prayer for bail before the court below, which will be considered keeping in view of the fact that coaccused has been granted bail and he will dispose of the bail application.
With the above observation, this application is disposed of.
