The petitioners seek Anticipatory bail in connection with Kotwali (Adampur) P.S. Case No. 707 of 2017 registered under Sections 341, 323, 353, 504, 506, 427, 120(B), 34 of the Indian Penal Code.

Allegation against the petitioners is that they abused in filthy language and assaulted the informant and also they put hindrance in discharge of official duty.

It has been submitted on behalf of the petitioners that husband of the petitioner No. 1 was Supervisor and during the "Tajiya" celebrations of Muharram festival, the main line got

No.48070 of 2018(2) dt.13-09-2018 2/2 touched and two persons died, the persons of Lodipur started assembling at the office of the informant and due to which husband of petitioner No. 1 was got arrested by the police and due to this fact all petitioners had gone to the office, but they were also implicated in this case. It has been further submitted that co-accused, namely, Raj Kumar Mandal @ Raj Kumar has been granted anticipatory bail by this Hon'ble Court vide order dated 27.02.2018 passed in Cr. Misc. No. 11607 of 2018. Petitioners have no criminal antecedent.

Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioners named above in the event of arrest or surrender before the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur, in connection with Kotwali (Adampur) P.S. Case No. 707 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
