JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-08-2019 The present writ petition has been filed for directing the respondent-authorities for removing the encroachment from Gairmazarua Aam land situated at village Uddaini, P.S.

Patna High Court CWJC No.16794 of 2019(2) dt.20-08-2019 2/2 Gopalpur, District Patna, P.S. No. 102, Tauzi No. 396, Khata No. 50, survey Khesra no. 340 and 341.

This Court is of the view that for the purposes of removal of the encroachment from the public land/ Gairmazarua Aam land, the petitioner is required to approach the Circle Officer under the provisions of the Bihar Public Land Encroachment Act, 1956.

Accordingly, the present writ petition stands disposed of with liberty to the petitioner to approach the respondent no.3 by filing an appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956 which shall be examined by the Circle Officer and, if maintainable, appropriate action shall be taken in accordance with law by taking the proceedings to its logical conclusion.
