Heard learned counsel for the petitioner and learned A.P.P. for the State, Shri Rabindra Kumar. 2.

The petitioner apprehends his arrest in a case registered for the offences punishable under Section 87 of the Bharatiya Nyaya Sanhita and Sections 8 and 12 of POCSO Act. 3.

The Investigating Officer of the case, in compliance of the order dated 9-9-2025, is present in the Court. 4.

From perusal of the allegation as alleged in the FIR, it would manifest that informant alleges that her daughter had gone to her aunt's place, from where petitioner kidnapped her on 1-2-2025.

The investigating officer of the case, who is present in the Court, submits that petitioner is a person with clean

Patna High Court CR. MISC. No.58840 of 2025(3) dt.15-09-2025 2/2 antecedent and victim has come back. It is also submitted that on the date of occurrence, the age of the victim was 17 years 11 months 26 days and her statement was recorded under Section 183 BNSS, wherein she had not supported the case of the prosecution rather had stated that she was in love with the petitioner and they fled. It is also submitted that victim was medically examined and she was found pregnant. 6.

Considering the submissions made by the Investigating Officer of the case, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mehendiya P.S. Case No. 23 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.

The personal appearance of the Investigating Officer of the case is dispensed with.
