JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-08-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Belhar P.S. Case No. 126 of 2018, registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 504, 506 of the Indian Penal Code and 27 of the Arms Act. As per F.I.R., allegation against the petitioners along with other accused persons came with deadly weapons and started abusing and indiscriminate firing with intention to kill in front of the informant, causing injury.
Submission of the learned counsel for the petitioners is that the petitioners have been falsely implicated in this case and
Patna High Court Cr.Misc. No.45393 of 2018 (2) dt.02-08-2018 2/2 dispute arose between the parties had no offence is made out under Section 307 of the Indian Penal Code. It is further submitted that the petitioners have no criminal antecedents. Learned A.P.P. opposes the prayer for.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, surrender be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Banka in connection with Belhar P.S.Case No. 126 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
