JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-04-2015 Petitioner is languishing in custody since 03.01.2015 in a case registered for the offences punishable under Sections 302/34 of the I.P.C and Section 27 of the Arms Act. Subsequently Sections 120B/212 of the I.P.C were also added.

One Yatindra Khaitan was shot dead by the miscreants. The name of the petitioner sprang up during investigation from his possession one mobile was recovered which reflects that the petitioner talked with the other accused persons just prior to the occurrence.

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent and the

Patna High Court Cr.Misc. No.13035 of 2015 (2) dt.02-04-2015 2/2 investigation has already concluded.

Considering the circumstantial nature of accusation against the petitioner having no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 01 of 2015.
