This writ petition has been filed with a prayer to direct the District Magistrate, Saran at Chapra to dispose of the appeal preferred by the petitioner under the provisions of the Public Distribution System (Control) Order, 2001 read with the Bihar Fair Price Shop Order, 2007 bearing P.D.S. Appeal No.51 of 2013.

It is the grievance of the petitioner that being aggrieved by the order dated 28.9.2013 passed by the licensing authority cancelling his Licence bearing no.21/07 that he preferred the appeal on 25.10.2013 but the same has remained pending.

Having heard learned counsel for the parties and

Patna High Court CWJC No.15574 of 2014 (2) dt.23-01-2015 considering the grievance raised, this writ petition is disposed of with a direction to the District Magistrate, Saran at Chapra to consider and dispose of the P.D.S. Appeal No.51 of 2013, if not already disposed of, in accordance with law and after giving opportunity of hearing to the petitioner expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order.
