JUSTICE SUDHIR SINGH ORAL ORDER 01-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25(1-b) a, 26 and 35 of the Arms Act. Allegation is that on getting information informant, S.I. cum Officer-in-charge, proceeded to nab a veteran criminal, namely, Sonu @ Govinda and after his arrest arms were also recovered from his possession.

It has been submitted on behalf of the petitioner that he is in custody since 14.6.2016. Chargesheet has been submitted against the petitioner. There is no allegation of tampering of witnesses against him. Petitioner is not named in the F.I.R. He has been made accused on the basis of confessional statement of the co-accused. There is no recovery of any arms from the possession of the petitioner.

On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
