JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Ballia P.S. Case No.163 of 2015, registered for offences punishable under Sections 341, 323, 363, 366(A), 368, 370(A), 370(D), 372, 373, 120B/34 of the Indian Penal Code and also under Sections 3, 4, 5, 6, 7, 8 and 9 of Immoral Traffic Act and also under Sections 4, 8 of POCSO Act.
As per F.I.R., allegation against the petitioner is of engaging two minor girls in the immoral trafficking and accordingly a seizure list was prepared.
Submission of the learned counsel for the petitioner is that he has been made accused only on the basis of that he is brother of Kalo Khalifa, who is accused of the case and the petitioner has
Patna High Court Cr.Misc. No.48516 of 2018 (2) dt.24-08-2018 2/2 been falsely implicated in this case. It is also submitted that the petitioner has no criminal antecedent.
Learned A.P.P. as well as learned counsel for the informant opposes the prayer for bail stating that both girls are minor and engaged in the illegal trafficking. Having heard both sides and in view of the facts and circumstances, as discussed above, I am not inclined to grant bail to the petitioner with a direction to the petitioner that if the petitioner surrenders before the Court below and makes prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court.
With the aforesaid observation, this application is dismissed.
