JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted for the offences under Sections 420, 406 and 120(B) of the I.P.C. The allegation is that the accused persons including the petitioners were caught with counterfeit currency. It has been submitted on behalf of the petitioners that the petitioners are in custody since 3.2.2016 and the charge sheet has been submitted in the present case. The petitioners got have no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners deny the allegations made in the F.I.R. There is no documentary proof to
Patna High Court Cr.Misc. No.29447 of 2016 (3) dt.06-09-2016 2/2 support the allegations made by the informant. It is further submitted that the petitioners are ready to deposit an amount of Rs.60,000/- jointly in the court below, which shall be subject to final disposal of the case.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners shall deposit an amount of Rs.60,000/- jointly in the court below, which shall be subject to final disposal of the case and on doing so, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. case No.50 of 2016.
