Petitioner seeks bail in a case registered for the offences punishable under Sections 47(A), 54 of Bihar Excise Amendment Act, 2016.
In huge quantity Indian made foreign liquor was recovered from a kelwani and the petitioner was caught from his boring. The informant claims that the aforesaid recovery was made on the basis of disclosure made by the petitioner but the aforesaid claim of the informant appears to be contradictory because in the self statement informant has admitted that prior to alleged recovery he had got confidential information regarding keeping of illegal liquor by the petitioner. Patna High Court Cr.Misc. No.26296 of 2016 (2) dt.11-07-2016 2/2 does not have any criminal antecedent and is languishing in jail custody since 30.04.2016.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali (Belsar O.P.)
