Petitioner seeks bail in Patepur P.S. Case No. 58 of 2012 registered for the offence punishable under Sections 147, 149, 341, 323, 452, 380, 307, 384, 379 and 504 of the Indian Penal Code.

Allegation against the petitioner is of causing head injury by means of Farsa on Informant.

Learned counsel for the petitioner submits that he is innocent and has been falsely implicated in this case due to animosity. According to injury report, injury has been caused by hard and blunt object which is simple in nature. Petitioner is in custody since 09.08.2021.

Considering the fact that there is direct allegation of causing injury over vital part of body as well as petitioner

Patna High Court CR. MISC. No. 65419 of 2021(2) dt.11-04-2022 2/2 remained absconding for many years and he is also accused in 4-5 cases, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.

However, petitioner may renew his prayer for bail after framing of charge. If charges have already been framed in this case, petitioner shall be released on bail by the court below itself on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, where the case is pending, in connection with Patepur P.S. Case No. 58 of 2012 subject to the conditions that:-

(1) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below.

(2) The petitioner shall fully cooperate with the investigation / trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
