The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 498(A), 341, 323, 504 and 506/34 of the Indian Penal Code and Sections 3/4 of the D.P. Act and 3/4 of the Muslim Women (Protection of Right on Marriage) Act, 2019.

It is a case of cruelty and torture to the informant and she has also been ousted from her matrimonial house by the accused persons including the petitioner.

It is submitted by the learned counsel for the petitioner that the petitioner had deposited Rs. 50,000/- which was received by the informant, namely, Ruksana Parveen and it is asserted on behalf of the petitioner that the petitioner is ready to deposit arrear of Rs.30,000/- at the time of filing of the bail

Patna High Court CR. MISC. No.65310 of 2021(2) dt.05-07-2022 2/2 bond. It is also asserted on behalf of the petitioner that in future he will obey the order passed by the court below to pay Rs.8,000/- per month as maintenance amount.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions and also the fact that petitioner is ready to pay the arrear of Rs. 30,000/- to the informant before filing of the bail bond, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sheikhpura in connection with Sheikhpura Mahila P.S. Case No. 06 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The aforesaid payments will be subject to any order passed in matrimonial or maintenance proceedings. (Sunil Kumar Panwar, J) Brajesh Kumar/- U
