2. The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihsr Prohibition and Excise Amendment Act.
3. As per prosecution case, 441 litres country made liquor has been recovered from a motorcycle.
4. It is submitted by learned counsel for the petitioner that nothing has been recovered from conscious possession of this petitioner and he has been made an accused in this case merely on suspicion. Petitioner is in custody since 18.06.2024.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.58782 of 2024(2) dt.06-09-2024 2/2 of the case, nature of accusation and period of custody, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions JudgeIV-cum-Exclusive Special Excise Court No.-II, Gopalganj, in connection with Kuchaikote P.S.
