JUSTICE SANJAY PRIYA ORAL ORDER 07-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mirganj P.S. Case 101 of 2016 instituted for the offence under Sections 395, 412, 414 of the Indian Penal Code, Sections 25(1-A), 26(ii) and 35 of the Arms Act.

It has been submitted that name of this petitioner has been disclosed by co-accused Bijendra Yadav who was apprehended on spot by the police. There is no recovery from his possession.

From the written report itself it appears that co-accused Bijendra Yadav was apprehended and disclosed the name of this petitioner.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.37373 of 2017 (2) dt.07-08-2017 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Mirganj P.S. Case No. 101 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
