JUSTICE JITENDRA KUMAR ORAL JUDGMENT Date : 29-07-2025 The present Criminal Revision Petition has been preferred by the Petitioner against the impugned judgment dated 29.06.2022, passed by learned Additional District & Sessions Judge-III, Sheikhpura in Criminal Appeal No. 23 of 2018 arising out of Trial No. 07 of 2022, whereby learned Appellate Court had upheld the judgment of conviction dated 11.12.2018 passed by learned Chief Judicial Magistrate, Sheikhpura in G.R. Case No. 781 of 2009, whereby learned C.J.M, had found him guilty under Section 25(1-B)a and Section 26 of the Arms Act.
2. The Petitioner has been sentenced to undergo R.I. for three years and fine of Rs.5,000/- under Section 25(1-B)a and R.I. for two years and fine of Rs.5,000/- under Section 26(1) of the Arms Act. However, by the impugned judgment, learned
Patna High Court CR. REV. No.660 of 2022 dt.29-07-2025 2/3 Appellate Court has reduced the sentence to R.I. for two years and fine of Rs.5,000/- under Section 25(1-B)a and S.I. for two years and fine of Rs.5,000/- under Section 26(1) of the Arms Act.
3. Learned counsel for the Petitioner informs that the Petitioner was arrested on 21.08.2009 in this case and thereafter, he was released on 19.07.2011 on bail. However, during pendency of this Criminal Revision Petition, he had again surrendered on 06.09.2022 and he was released on bail on 15.11.2022 by this Court. As such, the Petitioner remained in custody for two years one month and seven days, whereas the total sentence was only two years. However, in case of default to pay the fine, he was also directed to undergo additional imprisonment for two months and the Petitioner has not paid any fine. Hence, the Petitioner has served almost the total sentence.
4. Hence, learned counsel for the Petitioner is not pressing his petition against conviction. His only prayer is that the sentence should be reduced to the period of custody already undergone by the Petitioner.
5. Accordingly, the present petition stands allowed to the extent that the sentence is reduced to the period already

6. The bail bond of the Petitioner stands discharged, accordingly.
7. LCR be sent back to the Court concerned forthwith, with a copy of this order.
