It would appear from perusal of the first information report that allegation of firing is against petitioner and two others but post mortem report of the deceased reveals that one fire arm injury has been found on the person of the deceased and moreover, in course of investigation, witnesses stated that they were not sure whose firing hit the deceased.

Petitioner does not have any criminal antecedent. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in Kadamkuan P.S. Case no. 411/2014.
