2. At the outset, learned counsel for the petitioners seek permission to withdraw the pre-arrest bail petition of petitioner nos.1 and 2.
3. The bail petition in respect of petitioner nos.1 and 2 is dismissed as withdrawn.
4. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 325, 307, 354, 379, 504, 506, 34 of the Indian Penal Code.
5. Allegation against the petitioner is that he assaulted
Patna High Court CR. MISC. No.57456 of 2023(2) dt.31-08-2023 2/2 the son-in-law of the informant by means of butt of pistol.
6. Learned counsel for the petitioner submits that petitioner is innocent and had no committed any offence. There is a land dispute between the parties. There is general and omnibus allegation against the petitioner. Doctor has found simple injury. Petitioner has no criminal antecedent.
7. Learned counsel for the State opposes the bail petition of the petitioner.
8. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let petitioner no.3, Kunal Kumar, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Patna City, Patna in connection with Khusrupur P.S. Case No.114 of 2023, of subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
