JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Sour Bazar P.S.Case No. 486 of 2017, registered for offences punishable under Sections 341, 323, 379, 427, 384 and 504/34 of the Indian Penal Code.
As per F.I.R., allegation against the petitioners is that when the informant constructed hospital and equipped with all equipments and unknown accused persons started demand ransom and committed theft in hospital and allegation petitioner No. 1 is of assault by the butt of his pistol on the waist of the informant and petitioner No. 2 snatched Titan wrist watch from the informant.
Submission of the learned counsel for the petitioners is that the petitioners are named in the F.I.R. but nothing has been

No.45110 of 2018 (2) dt.01-08-2018 2/2 recovered from the possession of the petitioners and the informant purchased the land of Math after death of Mahanth and in this connection a case had already lodged bearing Sour Bazar P.S.Case No. 161 of 2010 against the informant. It is further submitted that the petitioners were appointed as Compounder in the Hospital of the informant after taking Rs. one lakh each but they were not paid salary for last several years, for which they lodged a Complaint case against the informant of this case. It is further submitted that the petitioners have no criminal antecedents. Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, surrenders be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand)each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S.Case No. 486 of 2017, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
