Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Saraiya P.S. Case No. 846 of 2020 registered for offence punishable under section 414/34 of the Indian Penal Code, sections 25(1-b)a, 26, 35 of the Arms Act and section 20/22 of the N.D.P.S. Act.

The learned counsel for the petitioner has submitted that the name of the petitioner has been figured in confessional statement of co-accused Arbind Kumar, who has been arrested

Patna High Court CR. MISC. No.65547 of 2021(2) dt.19-05-2022 2/2 and one kilogram of Ganja and pistol was recovered from the possession of co-accused Arbind Kumar, He has submitted further that the petitioner is a person of clean antecedent. Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Saraiya P.S. Case No. 846 of 2020, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
