Petitioner is named in the first information report but no specific overt-act has been attributed against him and it is only stated that he fled away from the place of occurrence saying that the enemy has been killed.
Learned counsel appearing for the informant fairly conceded this fact that in post mortem examination, only three wounds of entry were found but he submits that in course of investigation several eye witnesses stated that this petitioner along with other accused had fired on the deceased and furthermore, it is submitted on behalf of the informant that petitioner carries

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Muffasil P.S. Case No. 434 of 2014.
