The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 468, 304, 307, 504, 509/34 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act. It is alleged that petitioner being the ANM misdirected the informant and got admitted in Rahat Nursing Home run by Dr. M.R. Arif where the wife of the informant was admitted but dead male child was born when after the surgery some complications developed and informant contacted the petitioner and one Sonu, they abused by calling caste name. Subsequently the informant came to know that Nursing Home
Patna High Court Cr.Misc. No.36569 of 2014 (04) dt.17-04-2015 2/2 was run by Dr. M.R. Arif, Sonu and this petitioner. It is submitted by learned counsel for the petitioner that the wife of the informant was operated upon on 23.01.2014 when the FIR was lodged on 11.06.2014. It is not the case that the surgery was made by this petitioner, though the wife of the informant retracted from the initial version and filed a petition to that effect before the learned court below. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Danapur in connection with Paliganj P.S. Case No. 133 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
