Petitioner was neither caught on the spot nor anything was recovered from his conscious possession and, moreover, having more or less similar allegation, co-accused Kanhai Mahto has already been granted privilege of bail by the learned court below vide order dated 09.11.2015 passed in B.P.No. 1132 of 2015.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon P.S.Case No. 281 of 2015/G.R.
