JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner and the State. The petitioner is languishing in jail since 01.05.2016 in a case registered for the offences punishable under Sections 20, and 22 of the N.D.P.S. Act.

On secret information that trafficking of ganja was going on raid was laid in the house of Rupesh Baidya, Vicky Jaiswal and the petitioner shobha devi. From the house of Rupesh Baidya 50 K.G. Ganja, from the house of Vicky Jaiswal 25 K.G, Ganja and from the kitchen of petitioner Shobha Devi 05 K.G, Ganja were recovered.

It is submitted by learned counsel for the petitioner that the Ganja was recovered from the joint family house. The petitioner is lady. The quantity of recovery is between small and

Patna High Court Cr.Misc. No.29355 of 2016 (2) dt.27-07-2016 2/2 commercial quantity. Statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Mrs. Sharda Kumari learned counsel for the State does not dispute the recovery between small and commercial quantity.

Considering the fact that petitioner is a lady having no criminal antecedent, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge/Special Judge, Munger.
