Five petitioners, apprehending their arrest in Wazirganj P.S. Case no.103 of 2014 registered for the offence under Sections 147,148,149, 323, 324, 337, 307, 448, 380 of the Indian Penal Code, have prayed for grant of anticipatory bail. It was submitted by Sri Buxi S.R.P. Sinha, learned Senior Counsel, who was assisted by Sri Mrigendra Pratap Singh, learned counsel for the petitioners, that present F.I.R. was filed only with a view to create defence in a case i.e. Wazirganj P.S. Case No. 99 of 2014, which has been registered as per instance of
Patna High Court Cr.Misc. No.37224 of 2014 (2) dt.20-02-2015 2/2 the petitioners side. Besides this, it has been submitted that though in the F.I. R. it was alleged that Garasa was used, injury report, which has been brought on record, categorically suggests that no such injury was found on the person of the informant of the present case. It has been highlighted that F.I.R. was lodged from the petitioners side on 06.03.2014, whereas the present case i.e. Wazirganj P.S. Case No. 103 of 2014 has been registered on 09.03.2014, whereas the date of occurrence has been mentioned as 06.03.2014.
Keeping in view the facts and circumstances, let petitioners, namely, 1. Rajendra Chaudhary @ Chhote Chaudhary @ Chua Chaudhary 2. Ramawatar Chaudhary @ Gonga Chaudhary 3. Hero Chaudhary 4, Gore Lal Chaudhary 5. Samali Chaudhary, be enlarged on bail, in the event of their arrest or surrender within eight weeks from today, on furnishing bail bond of Rs.10,000/-( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Wazirganj P.S.
