Petitioner seeks bail in a case registered under sections 363, 365, 366A/34 of the Indian Penal Code which was converted into sections 372, 376, 406, 420, 467, 471, 120B of the Indian Penal Code, sections 3, 4, 5, 6A, 7/9 of Immoral Traffic Act and sections 6/7 of the POCSO Act.
Statement of victim, namely, Ankita Kumari has been recorded under section 164 Cr.P.C in which she specifically stated that it was co- accused Vikash Kumar who with the help of a female took her at bus stand and made captive in a hotel where said Vikash Kumar committed rape on her.
Petitioner is not named in the first information report but in course of investigation, it came to light that petitioner was manager of the hotel in which both victims had been kept. However, nothing has

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge I, Samastipur in G.R. no. 1063/2016 arising out of Tajpur (Halai O.P) P.S. Case no. 127/2016.
