The petitioner is languishing in custody since 19.07.2014 in a case registered for the offences punishable under Sections 399, 402 and 414 of the Indian Penal Code. On information that the miscreants are preparing to commit dacoity, raid was laid, when 4-5 persons were found sitting in suspected stolen Bolero vehicle when three managed to escape from the scene and petitioner and one Sumit Kumar were apprehended.

It is submitted by learned counsel for the petitioner that only on suspicion the petitioner has been arrested

Patna High Court Cr.Misc. No.14962 of 2015 (02) dt.07-05-2015 2/2 when similarly situated co-accused Sumit Kumar has been granted bail vide Cr. Misc. No. 6794 of 2015.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 464 of 2014.

Since the petitioner is accused in five other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
