JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 26.8.2014 in a case registered for the offences punishable under Sections 376/511 of the Indian Penal Code. And sections 8 and 12 of Prevention of Children from Sexual Offences Act. It is alleged that the petitioner entered into the house of the informant and tried to establish physical relationship with the daughter of the informant.
It is submitted by the learned counsel for the petitioner that for the occurrence of 25.2.2014 at 11.45 P.M. the FIR was registered on 26.2.2014 at 3.45 P.M. The informant has subsequently retracted from the initial version and filed a petition to that effect before the learned court below. It is further submitted
Patna High Court Cr.Misc. No.6519 of 2015 (2) dt.19-02-2015 2/2 that the victim has also retracted from the accusation and has filed a petition to that effect before the learned court below. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Patna in connection with Punpun P.S.
