This is an application for bail in connection with Daudnagar P.S.Case No. 164 of 2016 registered for the offences under Sections 323, 324, 326, 307 and 302/34 of the Indian Penal Code.

Allegation against the petitioner is of stabbing the deceased.

Submission of learned counsel for the petitioner is that co-accused Shanti Devi and Shaktiman Kumar have already been released on bail by this Court and further submission is that allegation of stabbing is against other accused persons and not specific against the petitioner and he is in custody since 10.1.2017. Heard learned APP as well as learned counsel for the

Patna High Court Cr.Misc. No.35896 of 2017 (2) dt.09-08-2017 2/2 informant, who have opposed the prayer for bail stating that several stab injuries were found on the person of deceased and prayer for bail of other accused has been rejected by order dated 29.6.2017 passed in Cr.Misc.No. 24066 of 2017. Having heard both sides and considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner.

However, learned trial court is directed to conclude the trial within one year.

With the above observation, this application is dismissed.
