JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-11-2022 Though, the present writ petition was filed for quashing Memo dated 19.04.2012, issued by the Block Development Officer, Rajaun, whereby and where under notice had been issued to the petitioner for depositing a sum of Rs. 50 lacks an odd but the same had stood dismissed by a Co-ordinate Bench of this Court by an order dated 05.03.2014, which was challenged in L.P.A. No. 295 of 2018, but the same was also dismissed by a learned Division Bench of this Court by an order dated 21.12.2018. Thereafter, the petitioner had preferred special leave petitions bearing SLP(C) No. 4057-4058

Patna High Court CWJC No.6581 of 2013(7) dt.07-11-2022 2/2 of 2020, which were converted into Civil Appeal No. 1436-1437 of 2020 and finally the same were allowed by the Hon'ble Apex Court by an order dated 10.02.2020 leading to restoration of the present writ petition and one other writ petition bearing C.W.J.C. No. 12288 of 2014 to the file of the learned Single Judge of this Court. As far as the aforesaid C.W.J.C. No. 12288 of 2014 is concerned, the same has stood disposed of vide order dated 07.11.2022 with liberty to the petitioner to assail the order dated 12.06.2014, passed by the Block Development Officer, Rajaun before the District Magistrate, Banka as also raise all his subsisting grievances.

In such view of the matter, the learned senior counsel for the petitioner submits that since the final order has not been passed by the Block Development Officer, Rajaun in pursuance to the aforesaid notice dated 19.04.2012 and liberty has already been granted to the petitioner to approach the District Magistrate, Banka, as aforesaid, by an order dated 07.11.2022, passed in C.W.J.C. No. 12288 of 2014, the petitioner, does not wish to press the present writ petition.

Accordingly, the present writ petition stands disposed off as not pressed.
