The petitioner seeks bail in Barachatti P.S. Case No. 254 of 2019, instituted for the offence under Section(s) 384, 385, 414, 406, 120B and 379/34 of Indian Penal Code. It is alleged in the written report that informant on getting information that some miscreants have collected toll tax illegally from the trucks loaded with iron, coal, cement etc. near Suryamandal Check Post, he along with police personnel reached the place of occurrence and started vehicle checking. During course of vehicle search, the informant saw one Motorcycle rashly coming from village Bhadeya. He gave signal to stop, but Motorcycle rider tried to run away. He was apprehended by the Police. He disclosed his name as Babar

Patna High Court CR. MISC. No.51138 of 2019(2) dt.21-08-2019 2/2 Khan (petitioner). On search, two Mobile Phones were recovered from his possession.

Counsel for the petitioner submits that petitioner has been arrested merely on suspicion. The Police made search of the petitioner and recovered two Mobile Phones from his possession. He further submits that aforesaid Mobile Phones belong to the petitioner.

Petitioner is in custody since 20.6.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barachatti, Distt. Gaya, in connection with Barachatti P.S. Case No. 254 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
