The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 379, 414 of the Indian Penal Code.

The petitioner along with co-accused person were arrested with stolen motorcycle bearing Registration No. BR-44F-9600.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is also

No.55280 of 2022(2) dt.16-02-2023 2/3 submitted that petitioner along with co-accused person confessed that they have purchased the said motorcycle from one Dharmendra Kumar after the payment and they have no knowledge that the alleged motorcycle was stolen one. Moreover, the petitioner is languishing in judicial custody since 13.06.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Similarly situated co-accused, namely, Mukesh Kumar has been granted Bail vide order dated 23.12.2022, passed in Cr. Misc. no. 54020 of 2022 by the co-ordinate Bench of this Court.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Arwal P.S. Case No. 271 of 2022 on furnishing bail
