JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2015 Petitioner is languishing in custody since 17.07.2014 in a case registered for the offences punishable under Sections 399, 402 of the I.P.C and Section 25(1-B)a of the Arms Act.

On the information that miscreants are planning to commit dacoity, raid was laid when from the possession of the petitioner one pistol and four live cartridges were recovered.

It is submitted by learned counsel for the petitioner that petitioner was taken by the police personnel from his house on 12.07.2014 against which the wife of the petitioner has filed a petition on 15.07.2014 before learned Sub-Divisional Judicial Magistrate, Patna City that STF people have taken her husband from the house and thereafter on 17.07.2014 the present case has been lodged.

No.6552 of 2015 (2) dt.19-02-2015 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Patrakar Nagar P.S. Case No. 163 of 2014.

Since the petitioner has serious criminal antecedent, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for two consecutive occasions during trial.
