2. The petitioner seeks bail in a case registered for the offence punishable under Sections-103 B.N.S., 2023.

3. According to FIR, the husband of the informant went from his house with the petitioner by a motorcycle. Her husband got down from the motorcycle and the petitioner proceeded ahead. Later on, at about 3.00 p.m. the petitioner returned and apprised the informant that the deceased was lying near the canal. Then the informant sent Raju Ram and the petitioner to bring back her husband as her husband was in injured condition. Thereafter, the injured was shifted to hospital wherefrom, he was referred to G.M.C.H. Bettiah where he was

Patna High Court CR. MISC. No.54351 of 2025(2) dt.12-08-2025 2/2 declared as dead.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. His name has figured only on the basis of suspicion. Except that, there is nothing against the petitioner in the entire case diary. There is no motive for killing of the husband of the informant. The investigation has completed and custodial interrogation is not required. The petitioner is in custody since m09-04-2025.

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Nautan P.S. Case No. 05 of 2025 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court. (Nawneet Kumar Pandey, J) A.K.V.//- U T
