The petitioner is in custody since 5.2.2015 in connection with Siwan Rail P.S. Case No.39 of 2014 registered for the offences under Sections 395 and 397 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a student of Intermediate and he has absolutely no concern in connection with the alleged offence. It is further submitted that though he is not named in the F.I.R., subsequently only because of the mobile, which is purported to have been looted, was recovered from his possession in which the petitioner had his own SIM that the petitioner has been taken into custody.
