JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 16.6.2016 in a case registered under Sections 354, 354(B), 354(C), 354(d), 506, 509 of the Indian Penal Code and Section 12 of POCSO Act. There is accusation against the petitioner that he used to tease the informant's minor daughter and on one occasion, he caught hold her hand and gave threatening to her. Submission on behalf of the petitioner is that no such occurrence as alleged in the first information report did ever take place and as a matter of fact the informant's daughter had sweet relation with the petitioner which was not liked by the informant

Patna High Court Cr.Misc. No.29620 of 2016 (2) dt.26-07-2016 2/2 and thereafter, the informant lodged this false case with concocted story.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge cum Special Judge, POCSO, Muzaffarpur in connection with Mithanpura P.S. Case No.139 of 2016.
