Having regard to the nature of allegation against the petitioner for offence under Section 406, 409 of the Indian Penal Code and Section 7 of the Essential Commodity Act and that there is alleged discrepancy of 4042 liter of kerosene oil and 216 quintal of food grains, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner namely Yugeshwar Prasad Yadav is rejected. Nothing said in this order, however, will come in the way of the petitioner in surrendering and making prayer for regular bail and in the event it is done so, the court below will be deciding the issue without being prejudiced by the rejection of prayer for anticipatory bail of the petitioner.
